WARRANTY & REFUND POLICY

LAND WARRANTY & WARRANTY RETURN POLICY

This Warranty, Warranty Service, and Warranty Return Policy describes our general warranty and product servicing or return policies. LAND reserves the right to modify or make exceptions to this policy at any time, including as needed to comply with local laws of individual jurisdictions.   

We warrant that during the applicable timeframes outlined in Section 1.1, the electronic motorcycle (the “Product”) will be free from defects in materials and workmanship. We limit the duration and remedies of all implied warranties, including without limitation, warranties of merchantability and fitness for a particular purpose to the duration of the express limited warranty outlined in Section 1.1(b). 

Some states do not allow limitations on warranties, including how long an implied warranty lasts. Depending on your location, the limitations in this warranty may not apply to you. 

 WARRANTY POLICY  

This Warranty Policy describes our general product warranty.  LAND reserves the right to modify or make exceptions to this policy at any time, including as needed to comply with local laws of individual jurisdictions; provided, however, that no changes shall apply retroactively unless required by applicable law. For additional product warranty terms, please refer to your product warranty card, service or customer manual.  

1.1.  Warranty

a.      Subject to the terms, conditions, and limitations herein, LAND warrants that the motorcycle and chassis will be free of defect in material or workmanship under normal use and service for two (2) years from the date of delivery (the “Bike Warranty”).  The Bike Warranty covers the chassis, motor, braking system (excluding brake pads), controller, display, and sensors, as applicable.

b.     LAND warrants that your battery will be free of defect in material or workmanship under normal use, charging, and storage, and will maintain at seventy percent (70%) or higher capacity for at least five hundred (500) charge cycles or one (1) year, whichever comes first (the “Battery Warranty”).  The Battery Warranty covers the physical battery, provided, however, that, like any rechargeable battery, your rechargeable battery pack will experience a decrease in capacity over time as it is subjected to charge and discharge cycles.

c.      In addition to the limitations contained therein, the limited warranties outlined in Section 1.1(a) and 1.1(b) do not cover damage due to abuse, neglect, misuse, fire, accident, collision, explosion, freezing, theft, overcharging or undercharging, alteration, improper installation, batteries charged by systems other than the original equipment type battery charger or charging systems not approved by LAND, use of special additives, unauthorized attempts to repair, or failure to keep the Product properly maintained, or any other damage arising from the unreasonable treatment of the Product or any of its key operational components, including damage due to weathering, or such other misuse or normal wear and deterioration. We reserve the right to request video, photo or written documentation of any defect claimed, and the right to accept or reject any warranty claim at any time.   

d.     LAND will not be liable for any punitive, consequential, or incidental damages, such as towing, electrical system test or damage, charging a battery, replacement or rental vehicles, loss of use of the Product, and damage to person or damage to property, other than the Product. LAND further disclaims any liability relating to or arising from any Misuse of the Product.

e.      This limited warranty controls all warranty claims. LAND makes no other express warranties. 

1.2. Exceptions. Under certain circumstances, some jurisdictions don't permit the disclaimers in Section 1.1 so they may not apply to you. In such an event, the disclaimers apply to the maximum extent permitted by applicable law. You may have other statutory rights and nothing in this Agreement affects your statutory rights or rights under mandatory laws. The duration of statutorily required warranties, if any, shall be limited to the maximum extent permitted by applicable law.  

1.3 Limitations.  Upon approval of a warranty claim, LAND will, at is sole discretion, either repair or replace the defective part or product.  Any other remedy, such as compensation for failure of any aspect of the Product is expressly excluded from coverage under all LAND warranties.  LAND warranties only apply to use of the product in accordance with its intended purpose, without modification, tampering or installation of third-party parts, accessories or electrical or mechanical components.  Commercial rental use and operation of the product is excluded.  

1.4 Use of Warranty. LAND provides this limited warranty only to the consumer who originally purchased the Product. It does not extend to any subsequent owner or other transferee of the Product. 

1.5 Warranty Claim Determination. The decision to accept or reject a warranty return or service is at the sole discretion of LAND. Warranty return shipping or warranty service shipping is the financial responsibility of purchaser. Proof of product registration and an original purchase receipt is required for valid warranty claims and return or service requests.    

1.6 Disputes.All disputes arising out of or in any way related to the LAND warranties will be resolved exclusively through binding arbitration in Cleveland, Ohio in according with the JAMS consumer arbitration rules and procedures. 

WARRANTY SERVICE

2.1 To obtain service to your Product pursuant to this warranty, you must contact LAND at [CONTACT INFORMATION] or email our customer service team at hello@LAND.email. All submissions for warranty service must be approved by LAND prior to any work being performed.

2.2 Upon approval of a warranty service request, LAND will provide you with additional information necessary to complete the service. 

WARRANTY RETURN  

3.1 MOTORCYCLES  

a.      Once your motorcycle is built, it is fully non-refundable and may not be returned other than in accordance with an eligible, approved warranty claim pursuant to this warranty policy.   

b.     We do not accept returns on vehicles after the MCO (Manufacturers Certificate of Origin) has been assigned in the consumer’s name, other than under an eligible, approved warranty claim.  

c.      We do not accept returns after a vehicle has been delivered, other than under an eligible, approved warranty claim.  Certain states do not allow restrictions on the return of new vehicles within a defined timeframe.  

3.2   BATTERIES & ACCESSORIES  

a.   We do not accept returns on accessories for any reason.  

b.  We do not accept returns on batteries after an order has been placed, other than under an eligible, approved warranty claim.  

c.  Warranty return requests must be sent for pre-approval to: hello@LAND.email.

LIMITATION OF LIABILITY 

4.1 THE REMEDIES DESCRIBED HEREIN ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
